Version secondshift-2026-10-20 · Effective October 20, 2026. Second Shift AI is a service of AZ Sun Valley Sales LLC, an Arizona limited liability company ("we", "us"). These terms apply to the free review and plan and to every paid build and monthly care plan. If you and we sign a separate service agreement, it controls where the two differ. You accept these terms by ticking "I agree" when you pay an invoice, or by using a paid service.
The website review, simulator and written plan are free and create no obligation on either side. The plan is yours to keep and use.
A build starts when its invoice is paid and follows the plan you approved. Changes in scope are quoted before they are built. Timelines are estimates and depend on access to your accounts and timely answers from you.
Invoices are paid through Stripe; we never see or store card numbers. Monthly care fees cover hosting, monitoring, updates, changes within your plan's scope and your plan's support window. Care is month-to-month after the build and renews each month until canceled; cancel with 30 days' notice by emailing [email protected]. Third-party fees (card processing, SMS carriers, domains, software subscriptions) are passed through at cost. Prices for future months may change with 30 days' notice.
If you cancel before any build work has started, we refund the build fee in full. After work starts, build fees are refunded only for work not yet performed, and monthly care fees are not refunded for partial months, except where the law requires otherwise. Annual or prepaid packages (including those bought on eBay) are refunded pro rata for full months not yet delivered.
Everything built for you (code, data, configuration, logins, domain) is yours. If you leave, we hand it over in working order and tell you how to run it.
The systems we build use artificial intelligence (currently Claude, by Anthropic) and other software. AI output can be wrong; you are responsible for reviewing customer-facing messages, prices, quotes and decisions your system makes or drafts, and for turning off any automation you do not want. On plans that include AI on-call, an automated system reads your support messages, may change your system to fix a reported problem, and logs everything it does; a human reviews escalations. We do not guarantee the uptime of third parties (payment processors, email providers, hosts).
We build and run software. We are not your lawyer, accountant, tax adviser or financial adviser, and nothing we deliver is legal, tax, accounting or financial advice. Savings and revenue estimates on this site and in plans are planning numbers based on stated assumptions, not guarantees; results depend on adoption and follow-through.
You will give us accurate information and the access we need, have the right to the data and accounts you share, and use the systems we build lawfully, including email, text-message, telemarketing, privacy and consumer-protection rules. We may pause work or an automation that we believe is unlawful or harmful.
We handle your data only to deliver the service, never sell it, and delete it on request when the engagement ends. See the Privacy Policy.
The services are provided "as is" to the fullest extent the law allows. We are not liable for indirect, incidental, special or consequential damages, lost profits or lost data, and our total liability for all claims is limited to the fees you paid us in the three months before the claim.
These terms are governed by the laws of the State of Arizona. Disputes are resolved in the state or federal courts in Maricopa County, Arizona. We may update these terms; changes are posted here with a new version date and apply to invoices paid after that date.
